Ensenada, B. C. - TheTijuana-Rosarito-Ensenada tourist corridor has been invaded by foreigners and they have limited access to the beaches for Mexicans, said the representative of the Ministry of Agrarian, Territorial and Urban Development (Sedatu) in Baja Calfiornia, Enrique Acosta Fregoso.

He predicted that the approval of the proposal to modify Article 27 of the Mexican Constitution, from his point of view, will increase and legitimize the problem of [foreign] invasion in Baja California, mainly in the coastal areas.

He said that around 80% of the habitable areas along the coastal corridor, in in the possession of foreigners.

He mentioned that in these cases the immigrants need to resort to the creation of a fideicomiso to have title to the property, which generally does not occur.

"The federal zone is a concept of national sovereignty, but we have a big problem due to lack of security of our beaches and federal zones in Baja California, above all on the Tijuana - Ensenada corridor," he said.

I think Mexicans want their beach and beach access back, and I can't blame them.

In front of our house a California company (Aries Management who does business in Baja under it's Mexican name Grupo Aries) built a condo tower 100% in the Federal Zone (Playa Bonita Condos), while a Texas lady tore off Federal Zone concession signs and offered the land for sale (she claimed she was Mexican-born and had lived there 20 years). These people steal the beach from Mexicans with the help of corrupt local officials, they don't do it alone. I hope they make strong examples of these land thieves.

How can Mexico make all the efforts to encourage foreign investment, then rescind their end of the bargain after the money has changed hands? Sounds like more Punta Banda expropriation.

I'm for giving the legitimate owners of the property their land titles and letting the chips fall where they may. Only then can legitimate foreign investment take place. There are still people who think a 99 year lease is legal in Mexico and nothing you can say will change their minds. You'll never fix the stupid buyer, but you can get land titles into people hands. This proposal (and the previous topic of Mexico talking about lifting purchase restrictions on foreigners in the coastal zones) will be painful for some and beneficial to others- but we shouldn't assume the worst. Maybe not all Americans were swindled or were set up to be swindled by "heirs" in the future with the papers they are holding today.



BTW: I have never seen the National Title for the land our house is on but Rancho La Costa Azul has told us it falls inside the boundaries of the coastal Rosarito Beach land they paid for in 1993. This is a huge problem affecting everyone. Our fraccionamiento was formed in 1975 and we're still not sure we actually own anything.

I wonder what he's refering to that doesn't occur? A Fideicomiso wouldn't be issued for Fed Zone land anyway. That's an area for a "Concession."

Another thing.....I wonder what percentage of land is occupied in the corridor, from tip to tip?
A small percentage, I would imagine. If the coastline was stretched out straight, it would run forever. That's the reason for the trivia question, "Which state in the contiguous US has the longest coastline?"
That would be Maine, and one could see that feature if the coastline was straightened out.
