Default Increase in Trust Fees?

When we went to Bancomer, Rosarito, in July to pay our trust fees for the year, our helpful () Trust executive let us know that the Trust fees are increasing 2% annually + tax.

He also said this was standard and many Americans were being fined for never paying the increase.

Has anyone else received this info?

Your fideicomiso might have a clause that spells out what the increase (if any) would be. A couple of our older fideicomiso's actually described how often, and by how much the fee increase would be.

I just looked at our current fideicomiso's and they don't mention anything about fee increases. I don't know if that means there will never be a fee increase, or if it's open for them to do what they want.

What would be interesting to know is if the fideicomiso is considered a legal contract, and in the absence of a clause describing fee increases, if they have to honor the agreed upon yearly rate.

This sounds strange. Why would "many Americans" not pay the increase? 2% of my fee would come to $6 per year ... hardly worth risking a fine!!

My 2006 fideicomiso (not with Bancomer) specifies that the fee can't be increased more than 10% in four years. It hasn't increased yet, but that doesn't mean it won't.

Kate, a LOT of people who don't live here full-time & aren't necessarily down here when it's time to pay their annual fideicomiso renewal either pay remotely or send a check. And they just keep sending the same amount year after year until they're notified of an increase, or they hear it through the grapevine. Unlike US banks, the Mexican banking system feels no need to notify their customers in writing of rate changes, so most people who don't acknowledge a rate increase do so out of lack of knowledge as opposed to making a conscious effort & refusing to pay it.
