It is a very important topic because there is no one place to go on-line or in person for this information in Spanish or English. This forum will allow the honest and civil exchange of Baja Real Estate advice and Information along with the posting of the actual legal documents and maps. No question presented is too simple, too complex or too controversial. The laws regarding Mexican real estate are fairly straightforward and are written into the Mexican constitution. It is the interpretation and application of these laws and the slow pace of the Mexican legal system that is variable.

This forum will work it's way up and down Baja California and Baja California Sur coasts to highlight the real estate problems that lurk below the surface- as well as the opportunites that exist for careful and informed investors.

Agreed. Lots of misinformation out there and most of it to be found on Baja real estate websites.

While many real estate offices are up to speed (more or less) on ejido land issues, most haven't a clue how uninformed they are on Baja property titles themselves. I have found many who have never heard of national land status/designation or don't know the difference between a national/colonial land title.

Maybe we can get a few working in real estate to participate in the discussion - it would certainly be interesting and enlightening...

Between 1915 and 1992, successive governments expropriated and redistributed over
half of Mexico’s total surface area, and 3.5 million land recipients and their families
participated in forming, transforming, and sustaining around thirty thousand ejidos and
agrarian communities (the land and labor arrangements that were the principal vehicles
for land distribution). Mexico’s agrarian reform (1915-1992) has been a key subject for
academic debates on peasant insurgency, hegemony, and resistance. Moreover, now
that Mexico has formally ended its historical commitment to land distribution, several
million agrarian subjects and their families continue to interact with agrarian agencies
and courts, and scholars have again adopted the concept of resistance to understand
local responses to present-day neoliberal reforms to land and labor arrangements in
rural Mexico.

Another aspect is the relative cost of the legal end, say the transfer of a fideo... Who can give good service, who has knowledge in a certain area etc... Do you have to have an fm3 to take title or will an fmm work. All sorts of questions. Of course the ever-changing laws do make a difference so update would be an important part.

That is an important consideration complicated by the fact the laws are inconsistently applied. Raphael may correct me, but it is my understanding that the laws are all there, it's just the political will to follow them to the letter that is lacking. Having a local person handle your paperwork is smart, but it also can backfire years later if they copied paperwork mistakes others in your area made.
