Ensenada, B.C. - Lo que sería un día más de trabajo, comenzó como un desalojo que afectó las actividades de 57 empleados del hotel, restaurante y "spa” La Fonda, quienes ayer vieron tirados en la calle los muebles y herramientas de sus labores cotidianas.

Conforme al testimonial de los trabajadores, el desalojo comenzó alrededor de las 9:00 horas, en el conocido sitio ubicado en el kilómetro 59, mismo que abarca 40 habitaciones (entre dobles y sencillas), un "spa” de tres pisos, salón de eventos y una casa habitación, distribuidos todos en 5 mil metros cuadrados.

Colchones, ropa, espejos, sillas, cuadros, y muebles para ropa, fueron algunas de las cosas que fueron arrumbadas a un costado de la carretera, mismos que llamaron la atención de los conductores que pasaron por el lugar.

Acusan de despojo

Alejandro Martínez Vázquez, representante legal, explicó que la operación sí es un desalojo en cumplimiento a la orden de un juez, pero también es un "despojo” a la concesión que tiene su cliente en zona federal.

"Las personas que vienen a cargo de la diligencia nos despojaron de la zona federal: tenemos una concesión que el gobierno nos dio. Nos están despojando de lo que es el hotel pero el restaurante seguirá abierto: dando el mismo servicio”, aseguró.

Refirió que el lugar cuenta con 57 empleados y tratarán de resolver la situación laboral de los mismos, pues más de la mitad saldrán afectados con la diligencia, quienes representan a su vez a veinte familias.

"El litigo es la Fonda Portfolio los que operan y va en contra del señor Joe Dmytriw Orestovich y su compañía operadora La Fonda.

"Hay abuso pero no podemos hacer nada: traen un perito que está deslindando la propiedad que es arquitecto, no es ni siquiera ingeniero. Es de Rosarito y se apellida Carrasco. Está delimitando de una forma tan vaga y tan malsana. Esa línea tiene que estar cinco metros para aquel lado, así lo marcan los mapas, la zona federal. Hay irregularidades”, aseguró.

El abogado recordó que desde el año 2008 comenzó el litigio, pero que de repente el juez a cargo del caso notificó de manera "irregular” desde la ciudad de Tijuana, y "sacó de repente un exhorto”, además de que pidió que fuera ejecutado por el gobierno de Ensenada.

Por lo anterior, harán una denuncia ante la Procuraduría General de la República (PGR) y pedirán la restitución correspondiente.

According to the statements of the workers, the eviction started around 9AM, at the will known location at kilometer 59, which contains 40 rooms (singles and doubles), a three-story spa, meeting room and a home, spread over 50,000 square feet.

Mattresses, clothing, mirrors, seats, paintings and dressers were some of the things which were cast beside the highway, which caught the attention of drivers passing by the location.

Accused of eviction

Alejandro Martínez Vázquez, legal representative, explained that the operation is an eviction in compliance with a court order, but also is an eviction from the federal concession his client has in the federal zone.

"The people who are in charge of the operation evicted us from the federal zone. We have a concession from the government. We are being evicted from the hotel, but the restaurant will continue open, providing the same service," he assured.

He said that the location has 57 employees and will try to resolve the labor situation for them, as more than half of them are affected by the eviction, which represents some 20 families.

"The litigation is the Fonda Portfolio and is against Mr. Joe Dmytriw Orestovich and his La Fonda operating company."

"There are abuses but we can do nothing. They have brought in an expert who is an architect and who is demarcating the property. He is not even an engineer. He is from Rosarito and his name is Carrasco. He is defining the property limits in a vague and unwholesome manner. The line should be five meters to the other side, that is how he is creating the maps, the federal zone. There are irregularities," he said.

The lawyer recalled that the litigation started in 2008, but suddenly the judge in charge of the case notified them in an "inappropriate" manner from Tijuana, and "whipped out an order," in addition he requested the order be carried out by the government of Ensenada.

For all of the preceding, there will be a complaint made to the Federal Attorney General and a demand for restitution.

Wow!!!
My husband had breakfast there yesterday morning on their way to Baja Mar to play golf. He mentioned when he came home that he thought La Fonda must be remodeling the rooms. Boy was he wrong. He said the restaurant was fairly quiet but to be expected on Thursday. We were rather exceted thinking the place was getting an over haul as it use to be fairly nice. Oh Well... I wish the best for the families that work there. They are the victims.

Apparently the restaurant is "fine" for now. How's that for a Federal Zone eviction? They throw all the Hotel belongings outside on the street. I can't imagine what legal scenario took place to allow this. Sadly, the same things can happen to people and their coastal condos and homes. Although most expats want to live at the coast, it is a snakepit of corruption. Too many horror stories about corrupt officials moving the Federal Zone lines back and forth to accomodate developers or connected people. Mexico had the chance to give investors peace of mind, but in the end rejected the ability of foreigners to own coastal land outright. Coastal land is where the money is and fairness isn't part of the equation. Mexico and the Baja PR machine will call out anyone who gives investors good reason to use caution on buying coastal properties- while staying silent when people and businesses are evicted like this. I don't know what it would take for fairness to exist in real estate here- it doesn't seem importnat to anyone once the money has changed hands. Maybe calling it a snakepit was too kind. jmho. Looking forward to more details on this...
